Revocation of draconian law in IHK false claims: legal experts

Srinagar, April 30 (KMS): In occupied Kashmir, legal experts have said that pro-India political parties are befooling people by promising revocation of Armed Forces Special Powers Act (AFSPA).

As the so-called elections come nearer, the pro-India parties like Farooq Abdullah’s National Conference and Mufti Sayeed’s Peoples Democratic Party are making tall claims to review the law.

AFSPA gives unbridled powers to Indian Army personnel in the occupied territory. They can kill people even on the basis of suspicion and raze inhabited structures to ground. The law was implemented in 1990 to quell the Kashmiris genuine struggle.

A noted lawyer, Mian Abdul Qayoom said the parties can just recommend New Delhi for the review of the draconian law like AFSPA, and cannot repeal it on their own. He added that none of these parties had made a sincere effort to revoke the law.

“Even if AFSPA is abolished, India has a sleeping dragon in its armour in the form of Disturbed Areas Act,” Qayoom said, adding, “Permission has to be taken from New Delhi, which is averse to the idea. “

The Bar President, Nazir Ahmed Ronga said that no legal action could be taken in 300 cases where in troops were found to have carried gross human rights violations under the cover of AFSPA. “The Government of India didn’t allow the proceedings against them,” Ronga added.
