Police officer involved in custodial killing in IHK

Srinagar, April 17 (KMS): In occupied Kashmir, the so-called State Human Rights Commission (SHRC) has asked the puppet administration to conduct a full-fledged inquiry into the killing of a 9th standard student, Mushtaq Ahmed, a resident of Rajouri district.

Mushtaq disappeared from his house in July 2006 and was killed in police custody in the same month.

"In case the custodial death is established the then SSP Operations, Doda should be sought for prosecution under law", acting chairperson of the SHRC Habibullah Butt observed in his judgment.

Mushtaq's father, Haji Mohammed Aslam had petitioned before the commission that his son disappeared from his home and he reported the matter at Police Station Mendhar. He further told that he had no contact with his son since his disappearance and he came to know through a local Newspaper that Police Station Doda arrested his son. When Haji contacted the police station, they denied of any arrest of a person whose name had figured in the newspaper. Then Haji had filed Heabus Corpus (illegal detention) petition in the High Court in Jammu.

"During the hearing of petition, Mushtaq's father had submitted school records and photographs of his son. The petitioner's main thrust was that his son was seen in Joint Interrogation Centre, Doda by the police officials, " the commission judgement reads.

The judgment further reads that Mushtaq’s father revealed that the SSP Doda had demanded Rs. 3 lakh from him for the release of his son and because of his inability to pay the amount, the SSP Doda killed his son in the custody.

In his judgment, Butt said, "Instances have come to the notice where the police has arrested the person without warrant and not recording the arrest, adding, the arrestee has been subjected to torture which might have resulted in his death in custody.”
